Fire Danger prompts Fax and Printer Recall

I think we all assume that the products we buy will not spontaneously catch fire. Unfortunately, this is not always the case. On February 2nd, 2012, the Consumer Product Safety Commission (“CPSC”) announced the recall of certain Konica Minolta and Hewlett-Packard FAX machines and printers because they pose fire and burn hazards.

The defective products affected by the recall are:

Konica-Minolta printers which have been known short circuit and overheat. Models Bizhub C35, Bizhub C35P Magicolor 4750DN and Magicolor 3730DN,

HP fax machines overheating and catching fire. Model HP 1040 and HP 1050.

Nearly a million of these printers and fax machines were sold in the U.S. The CPSC recommends people stop using these products immediately and disconnect them from the outlet.

What does the I 75 pile up teach us

Our hearts here at the Bodiford Law Group go out to all the families that lost loved ones in the fatal pile up on I-75 on January 29th. Since the fatal accident our website and our phones have been filled with questions from former and current clients asking how something like this happens and even more importantly how to avoid such tragedies.

While not common, it seems that every few years you hear about a situation like this somewhere around the country. Whether the tragic I-75 accident in Tennesse form the 1990′s or the fairly frequent pile up in the California central valley one thing is certain, visibility is a significant factor in multi-car collisions.

While accidents cannot be completely avoided it is wise to take precation when driving through dense fog or smoke even if a government agency has cleared the road as safe. Clearly the official govenment opening of I-75 near Gainesville was premature. Recalled Knee Implants Cause Serious Injuires And Damages

For the last few years the general public has probably heard alot about Hip implants and te lawsuits related to recalled depuy hip implants and other such devices. While not as prevalent but equally damaging are recalled knee implant devices.

One company that has had serious issues with both hip and joing implants is Stryker Howmedica Osteonics Corporation. The company is a large medical device manufacturer specifically in the area of joint implnat products

After numerous complaints, in 2007 the U.S. Food and Drug Administration sent letters to Stryker warning the company to fix failures in following procedures for testing problematic components. These warnings were primarily targeting knee replacement components (Duracon and Scorpio), hip replacement systems and Reconstruction & Trauma Cable System. In its later warning, the FDA reprimanded the company for its inability to implement adequate corrective and preventive measures in order to prevent recurrence of non-conforming products.

In January 2008, Stryker Corporation issued a voluntary recall of its ceramic Trident Acetabular PSL Cups and Trident Hemispherical Cups. The hip-knee implant recall involved prosthetic products which were manufactured at Stryker’s Ireland facility. The Stryker recall raised serious questions about the kind of quality controls employed by the company.

Wrongful Death Settlement Reached In Fatal Motorcycle Accident

An experienced motorcycle rider was killed in Orlando, Florida, Orange County. The fatal accident occured when a large commercial truck pulled directly into the path of his motorcycle. Dog Bite Settlement for woman injured by a pit bull attack

An Orange County woman living in an apartment complex was bit in the leg and dragged a distance by a Pit Bull dog owned by a neighbor in the complex. Although the lease did not allow for Pit Bull dogs in the residences, the owner kept one anyway. The landlord had been notified of the �aggressive dog� but failed to take any measures before the Plaintiff was bitten. As result of the bite, she required stitches and several reconstructive surgeries. The parties were able to reach a confidential settlement.

Faulty Seat Belt Design / Pharmacy Malpractice Settlement

In another faulty seat belt design case, a man was killed when his vehicle went off the road and struck a tree. His death was caused by his automatic 2 point seat belt which he was using without a lap belt, which cut his liver in half. Suit was brought against the auto manufacturer and Eckerd Corporation. The gentlemen was on three medications from three separate doctors which Eckerd filled without giving him the warning that their computer suggested regarding the contradicting indications of these drugs. As a result he became sleepy and ran off the road and hit the tree. Even though he hit the tree he would have lived but for the poorly designed seat belt system which cut his liver in two. He probably would not have died if he had his lap belt on, the lap belt was not integrated into the shoulder belt system, and the manufacturer failed to put any warnings on the visor or elsewhere of the hazard of not wearing the lap belt with shoulder belt system. The entire case was settled for a confidential amount.

Important to our clients: In an appeal, Raymond Bodiford made NEW LAW in Florida which states that the pharmacy has a duty to warn of known contradictions of medicine prescribed by different doctors if they undertake to do so. Previous cases against pharmacies were unsuccessful with the Courts finding they did not have any responsibility or a legal duty.

Child Airbag Death results in confidential settlement to the family

Ford Motor Company has agreed to a confidential settlement with the family of a five- year-old boy who was killed when the passenger side airbag of a 1996 Crown Victoria deployed after a low speed collision which caused almost no damage to the front of the mother�s vehicle. The mother had four children in the Crown Victoria. She had twins in separate car seats in the back seat, a seven-year-old in the middle-front position, and the deceased child in the right-front position. The child that was in the middle-front position was not injured. Plaintiff contended all the children were properly restrained. Ford contended none of the children were properly restrained and that the mother should not have had the child in the front seat.

US Coast Guard Releases 2010 Recreational Boating Accident Statistics

The United States Coast Guard recently releseaed their 2010 data on recreational boating accidents. The good news is that fatal accident are donw from the prior year. The bad news of course is that recreational boating is still a hazardous use of leisure time.

As a large boating state, Florida has more than its’ fair share of  boating accidents.n fact Florida led the nation in bosting accidents, boating accident deaths and property damage. In 2010 Florida had 65 boating fatalities and 249 serious injury accidents. Most of the time these accidents are caused by a negligent boat operator and many times alcohol is involved. Attorney Raymond O. Bodiford serves as Product Liability Section Chair for the American Association of Justice

Florida product liability lawyer Raymond Bodiford recently served as chair of the Products Liability Section of the American Association of Justice (formerly the Amertican Trial Lawyers Association) for the AAJ Annual Convention held in New York City.

Mr. Bodiford was responsible for the selection and coordination of product liability educational and semnars for attorneys from throughout the United States and many international attendees. In addition to his duites as Chair he also taught a special seminar on “Defective Seat belts in Cars, SUV’s and Heavy Trucks”

An article in a recent New York Times newspaper discusses the alarming failure rate of metal-on-metal (MoM) implants. We have seen a number of these types of issues in Central Florida  While Depuy has become synonomous with hip implant failure and recalls they are clearly not the only manufacturer to have issues.
